DeVito Departures — Cancellation & Refund Policy
Effective Date: October 2, 2026
1. Purpose and Scope
This Cancellation & Refund Policy applies to travel planning, reservations, and booking services provided by DeVito Departures through devitodepartures.com, by telephone, email, or other communication channels.
This Policy is incorporated into and forms part of the DeVito Departures Website Terms of Service. If there is a conflict between this Policy, the Website Terms of Service, a client invoice or booking confirmation, and the applicable travel supplier's terms, the following order generally applies:
- Mandatory applicable law;
- The applicable supplier's terms and conditions;
- The client's invoice or booking confirmation;
- This Policy; and
- The DeVito Departures Website Terms of Service.
Any more specific written terms stated on a client's invoice or booking confirmation control over the standard guidelines in this Policy.
2. Supplier Terms Control Your Trip
Cruise lines, airlines, tour operators, rail operators, resorts, hotels, transfer companies, travel insurance providers, and other travel suppliers establish their own deposit requirements, payment deadlines, cancellation schedules, change fees, refund rules, and travel-credit policies.
The supplier's terms control the amount, form, and timing of any refund, credit, or other compensation available for a canceled or changed booking. DeVito Departures does not set or control supplier cancellation penalties and cannot waive, reduce, or guarantee a supplier's fees or restrictions.
The standard timelines and penalty schedule in this Policy are general planning guidelines only. They are used when a supplier's specific terms have not been provided or when a booking confirmation does not state different terms. The supplier's actual terms may be more restrictive, including terms imposing a 100% cancellation penalty immediately after booking.
3. DeVito Departures Service and Planning Fees
DeVito Departures may charge a separate planning, research, administrative, ticketing, consultation, or other service fee. Any applicable fee will be disclosed before or at the time of payment and may be listed on the client's invoice or booking confirmation.
DeVito Departures service and planning fees are separate from the travel supplier's charges and are non-refundable once the applicable services have been performed or the booking work has begun. These fees are not returned when a client cancels a trip, receives a supplier refund or credit, or is unable to travel.
A supplier refund does not include a refund of any DeVito Departures service or planning fee unless DeVito Departures expressly agrees otherwise in writing or applicable law requires otherwise.
4. Deposits
A deposit is generally required at the time of booking to hold a reservation. The amount and due date of the deposit are determined by the applicable supplier.
Unless the supplier's written terms state otherwise, deposits are generally non-refundable once paid. A deposit may also include non-refundable supplier fees, promotional restrictions, or other charges that cannot be recovered after booking.
Payment of a deposit constitutes acceptance of the supplier's applicable booking terms, including the supplier's cancellation and refund conditions.
5. Final Payment
As a general industry guideline:
- Final payment for cruises is generally due approximately 90 days before departure.
- Final payment for escorted land or rail tours is generally due approximately 60 days before departure.
The exact final-payment date is stated on the client's invoice or booking confirmation and may differ based on the supplier, itinerary, destination, fare type, group booking, promotion, or other booking condition.
If final payment is not received by the stated deadline, the supplier may automatically cancel the reservation, retain the deposit, impose cancellation penalties, or deny the requested booking. DeVito Departures is not responsible for penalties or losses resulting from late, declined, incomplete, or unauthorized payment.
6. Client-Initiated Cancellation Penalties
A cancellation request must be submitted in accordance with Section 12 of this Policy. The following schedule is a general default model and does not replace the supplier's actual cancellation terms:

The applicable cancellation period is calculated using the supplier's stated departure date and time. Some suppliers calculate penalties differently, including by reference to the date and time the cancellation is received, the date of final payment, or the date a ticket or travel document is issued.
Some promotional fares, restricted fares, group bookings, cruise deposits, tour packages, hotel rates, airfares, and other products may be non-refundable or subject to a 100% penalty at any time, including immediately after booking.
7. Items Commonly Non-Refundable
The following items are generally non-refundable once issued, purchased, or confirmed:
- Airline tickets and airfare;
- Airline seat assignments and ancillary services;
- Private transfers and transportation;
- Pre-trip and post-trip hotel stays;
- Excursions and activities;
- Travel insurance premiums;
- Visa, passport, entry, and documentation fees;
- Promotional or restricted fares;
- Third-party add-ons;
- Supplier service fees;
- DeVito Departures service and planning fees; and
- Other items identified as non-refundable in the invoice, booking confirmation, or supplier terms.
Refundability is always determined by the applicable supplier's terms and the specific product purchased.
8. Cancellation Versus Changes and Name Corrections
A cancellation ends all or part of a reservation and may trigger the cancellation penalties described in this Policy or in the supplier's terms.
A change modifies an existing reservation, such as changing travel dates, itinerary components, room categories, cabin categories, passenger details, flights, transfers, or other arrangements. A change may be treated by the supplier as a cancellation and rebooking, which can result in cancellation penalties, repricing, loss of promotional benefits, and a new deposit or payment requirement.
A name correction is a limited correction to a traveler's name and is not necessarily treated as a cancellation. However, suppliers may restrict name corrections or treat a name change as a cancellation and rebooking. Passport and government identification requirements may also apply.
Supplier change, rebooking, name-correction, ticketing, or administrative fees may apply. DeVito Departures may also charge a separate administrative or service fee for processing a change or name correction. Any applicable fees and penalties will be disclosed when known.
No change is effective until confirmed in writing by DeVito Departures and, where applicable, accepted and ticketed by the supplier.
9. Missed Departures and Unused Travel
There is generally no refund for:
- Missing a departure;
- Arriving too late to board a flight, cruise, train, tour, transfer, or other scheduled service;
- Failing to appear for a reservation;
- Leaving a trip early;
- Voluntarily skipping any portion of an itinerary;
- Failing to use a ticket, reservation, hotel night, excursion, transfer, or other purchased service; or
- Failing to comply with the supplier's check-in, boarding, documentation, or timing requirements.
A missed departure may cause the supplier to cancel the remaining portions of an itinerary without refund. Clients are responsible for contacting the applicable supplier or DeVito Departures as soon as possible if a delay or emergency may cause a missed departure.
10. Supplier-Initiated Cancellations and Itinerary Changes
A supplier may cancel, delay, reroute, reschedule, substitute, or materially change a trip or any portion of an itinerary. Supplier decisions may result in a refund, future travel credit, rebooking option, voucher, alternate service, or no compensation, depending on the supplier's policy and applicable law.
DeVito Departures will make reasonable efforts to notify affected clients and assist them in communicating with the supplier, requesting available refunds or credits, and reviewing available alternatives. DeVito Departures does not guarantee that a supplier will provide a refund, credit, replacement trip, or other remedy.
DeVito Departures is not responsible for supplier insolvency, default, operational decisions, schedule changes, service interruptions, delays, cancellations, overbooking, lost services, or failure to provide a contracted travel component. Any refund or credit resulting from a supplier-initiated action remains subject to the supplier's terms and procedures.
11. Force Majeure and Events Beyond Control
Cancellations, interruptions, delays, or changes caused by events beyond the reasonable control of DeVito Departures or a supplier may include:
- Severe weather;
- Hurricanes, floods, earthquakes, wildfires, or other natural disasters;
- Pandemics, epidemics, or public-health emergencies;
- Government travel restrictions, border closures, or official advisories;
- War, terrorism, civil unrest, or security events;
- Strikes, labor disputes, or transportation interruptions;
- Supplier insolvency or operational disruption; and
- Other events that make travel impossible, unsafe, or commercially impracticable.
These events are handled under the applicable supplier's policy, the client's booking terms, applicable law, and the DeVito Departures Website Terms of Service. A force majeure event does not automatically create a right to a full refund. Available remedies may include a refund, future travel credit, rebooking, or no refund, depending on the supplier and the circumstances.
12. How to Submit a Cancellation Request
All cancellation requests must be submitted in writing to:

A cancellation request should include:
- The traveler's full name;
- Reservation or booking number;
- Trip or departure date;
- Description of the services being canceled; and
- A telephone number or other contact information.
A cancellation is effective when DeVito Departures receives the written request, provided that the request contains enough information to identify the booking. Requests received outside normal business hours, on weekends, or on holidays may be treated as received on the next business day.
Because suppliers may calculate penalties using their own deadlines and time zones, clients should not wait until the last day of a cancellation period. A telephone message, text message, social-media message, or communication sent directly to a supplier does not constitute a cancellation submitted to DeVito Departures unless DeVito Departures confirms receipt in writing.
13. Refund Processing
Any refund is subject to the applicable supplier's approval, terms, and processing procedures. DeVito Departures will submit or process an eligible refund request within a reasonable time after receiving the required information and any refund from the supplier.
Unless a different period is required by law or stated by the supplier:
- Supplier-approved refunds received by DeVito Departures will generally be forwarded or processed within five business days after receipt and reconciliation;
- DeVito Departures will generally provide the refund using the original form of payment;
- A refund is considered received by the client when the refunded funds are credited to the original payment account or otherwise made available by the payment processor; and
- The client's bank, credit-card issuer, or payment processor may require additional time to post the funds.
DeVito Departures may deduct any permitted cancellation penalties, non-refundable supplier charges, service fees, administrative fees, or other amounts authorized by the booking terms before issuing a refund.
If a supplier issues a future travel credit instead of a cash refund, the credit will be subject to the supplier's expiration date, restrictions, blackout dates, traveler limitations, and other conditions.
14. Travel Insurance Is Strongly Recommended
Comprehensive travel insurance is strongly recommended for every booking. Travel insurance may help protect against covered cancellation, interruption, delay, medical, evacuation, baggage, and other travel-related losses.
Where available, clients should also consider cancel-for-any-reason coverage. Cancel-for-any-reason coverage is not included in every policy, may have eligibility requirements, may reimburse only a percentage of the trip cost, and may require purchase within a specific period after the initial trip payment.
Travel insurance is the client's best protection against cancellation penalties and other covered losses. Supplier cancellation policies and this Policy generally continue to apply even when a client cannot travel because of illness, injury, family emergency, work obligations, weather, fear of travel, or another personal circumstance unless the applicable insurance policy or supplier waiver provides coverage.
A separate Travel Insurance Acknowledgment form will be provided to the client. Clients are responsible for reviewing the policy, exclusions, limitations, eligibility requirements, deadlines, and claims procedures. DeVito Departures does not determine whether a particular policy is adequate for a client's needs and does not guarantee that a claim will be approved.
Travel insurance is not required to purchase travel services. Any travel insurance selected by a client must be affirmatively requested or accepted and will not be added through an automatic opt-out process. Insurance-related questions should be directed to the licensed insurance provider or producer identified in the applicable insurance materials.
15. Payment Disputes and Chargebacks
Clients should promptly contact DeVito Departures in writing at nikolas.devito@devitodepartures.com with any billing concern, disputed charge, cancellation issue, or refund question. DeVito Departures will make reasonable efforts to investigate and resolve the concern.
Before initiating a credit-card or payment-provider chargeback, the client agrees to provide DeVito Departures a reasonable opportunity to review the issue and provide supporting booking, payment, cancellation, and refund information. This provision does not prevent a client from exercising rights that cannot lawfully be waived or from disputing an unauthorized transaction.
A chargeback does not automatically cancel a booking or eliminate amounts owed under the supplier's terms or this Policy. DeVito Departures may provide the payment processor with relevant booking records, invoices, confirmation documents, cancellation terms, communications, and proof of services performed.
16. Client Responsibility for Booking Information
Clients are responsible for reviewing all invoices, booking confirmations, passenger names, travel dates, destinations, payment deadlines, cancellation terms, travel documents, and other booking information promptly after receipt.
Clients must notify DeVito Departures immediately of any error or discrepancy. DeVito Departures is not responsible for losses resulting from inaccurate information supplied by a client, failure to review booking documents, missed payment deadlines, failure to obtain required travel documents, or failure to follow supplier instructions.
17. No Waiver of Mandatory Rights
Nothing in this Policy is intended to waive, limit, or exclude any consumer protection, refund, cancellation, insurance, or other right that cannot lawfully be waived or limited under applicable law.
If any provision of this Policy is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
18. Governing Law
This Policy is governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except to the extent that mandatory law requires application of another jurisdiction's law.
Any dispute concerning this Policy will be handled in a court of competent jurisdiction as permitted by applicable law.
19. Revisions and Amendments
DeVito Departures may revise or amend this Policy from time to time by posting an updated version on devitodepartures.com and updating the Effective Date.
A revised Policy applies to bookings made or services purchased after the revised Effective Date unless applicable law requires otherwise. The version provided with the client's invoice or booking confirmation generally applies to that booking, subject to mandatory law and the applicable supplier's terms.
